Terms of Service

These Terms of Service apply to the Balance website, the Balance: Plant-Based Fitness app, app memberships and online coaching services operated by Shannon Rhys Birch (ABN 90 855 738 343) under the Balance brand.

Important: Balance provides fitness, nutrition and behaviour-change support. It is not a medical service and is not a substitute for medical advice, diagnosis or treatment. You are responsible for deciding whether the service is suitable for you and for seeking medical advice where needed.

1. Acceptance of These Terms

By using Balance, creating an account, buying a subscription or receiving coaching support, you agree to these Terms, the Privacy Policy, the Client Agreement where applicable, and the Refund Policy.

You must be at least 18 to buy paid coaching or subscription services unless a parent or guardian gives consent.

2. Services

Service inclusions may change as the app and coaching model improve. Any paid plan will show its key inclusions and price before purchase.

3. Health, Safety and Screening

You agree to provide accurate health, injury, medication, pregnancy, limitation and exercise-history information when asked. You must stop exercising and seek professional help if you feel chest pain, dizziness, severe pain, faintness, unusual shortness of breath or any other concerning symptom.

Balance may ask for medical clearance, decline coaching, pause access, modify a program or refer you to a health professional if the service appears unsuitable or unsafe.

4. Accounts and Community Use

You are responsible for keeping your login details secure and for the activity on your account. You must not misuse the app, harass others, upload unlawful content, attempt to access another account, copy paid content for redistribution, or use Balance in a way that harms the service or other members.

5. Payments, Subscriptions and Renewals

Paid plans are billed in Australian dollars unless stated otherwise. Payments may be processed by Stripe, Apple, Google or another payment provider. By buying a subscription, you authorise recurring billing until cancelled according to the cancellation process for that payment provider.

Balance Online Coaching is billed weekly. The six-month option has an initial minimum of 26 weekly payments at AU$29.99, the three-month option has an initial minimum of 13 weekly payments at AU$49.99, and the month-to-month option has an initial minimum of four weekly payments at AU$74.99. After the selected initial minimum ends, coaching continues at the same weekly rate until cancelled.

6. Cancellation

For direct Balance recurring subscriptions purchased on or after 1 September 2026, cancellation requires 30 days' notice. Billing and access continue during that notice period. If an Online Coaching request is made during the selected initial minimum, cancellation takes effect on the later of the end of that minimum or the end of the 30-day notice period, and the remaining agreed payments stay due. Subscriptions purchased before that date keep the cancellation terms accepted at purchase. Apple App Store and Google Play subscriptions must be cancelled through the relevant store and follow that store's cancellation timing. Nothing in this clause limits rights under Australian Consumer Law.

Use the Balance cancellation page to view the applicable timing and cancel online. Account deletion is separate and does not itself cancel Apple or Google billing.

7. Refunds and Consumer Guarantees

Refunds are handled under the Refund Policy. Nothing in these Terms limits your rights under Australian Consumer Law. If a service has a major failure or does not meet a consumer guarantee, you may be entitled to a remedy under law.

8. Client Agreement for Paid Coaching

Before paid coaching begins, you may be asked to complete a health screening and accept the Client Agreement. This covers coaching scope, safety responsibilities, communication expectations, progress-photo permission, privacy consent and limits of service.

9. User Content and Testimonials

You retain ownership of photos, messages and content you submit. You grant Balance permission to use that content only as needed to provide the service. Balance will not use identifiable progress photos, testimonials or screenshots in marketing without your permission.

10. Intellectual Property

Balance owns or licenses the app, design, workouts, programs, text, graphics, systems and other service content. You receive a personal, non-transferable licence to use paid and free content for your own health and fitness journey. You must not copy, sell, share or republish it without permission.

11. Privacy

Balance handles personal and health-related information under the Privacy Policy. By using the service, you agree to the collection and use of information described there.

12. Availability and Changes

Balance aims to keep the app and services available, but interruptions, maintenance, app-store issues, payment-provider issues or third-party outages may occur. We may update, change or remove features where reasonably needed.

13. Liability

To the maximum extent permitted by law, Balance is not responsible for indirect loss, loss caused by incorrect information you provide, misuse of the service, third-party outages, or injury that occurs when you ignore safety guidance or medical advice. This does not limit rights that cannot be excluded under Australian Consumer Law.
